A dispute in the Federal Court has recently occured involving two big online dating sites. The argument has come up over unjust competition, unlawful use of Anastasia’s brand, false advertisement and so on and so forth. The proceedings are now being held in the New York Federal Court. For their site, Anastasia takes advantage of the websites Anastasiadate together with Anastasiadate.com. Despite the misconception that EM Online are based in the United States, they are in fact located in Australia.
“The Complaintant offers an international online dating service which, for a fee, matches adult men in the USA with girls in the Russian Federation and Ukraine. Probably the most targeted area of the states is New York”, claims the report. “Elena’s Models is really a direct competitor of Anastasia. It operates the elenasmodels.com web site and competes for similar prospective buyers as Anastasia in the U.S. “Based upon details and belief, Elena’s Models operates or sponsors online websites titled ‘anastasiadatefraud.com’ and ‘ruadventures.com.'”. The websites’ owners cannot be identified as a result of a proxy service being used, which makes things suspicious as you would expect. Nevertheless, they redirect customers to the elenasmodels.com website. The premise of the fake marketing accusation stands because of the fact that the two internet sites accuse Anastasiadate of cautiously and indefinitely scamming customers and deceive the clientele when purchasing their services, and after that go on to state that the accused, elenasmodels.com, is actually a totally safe and reliable dating site. “The anastasiadatefraud.com web site is designed to reveal and uncover emails written by the females who have accounts on Anastasiadate.com. The e-mail extracts all have a typical message – the women featured on Anastasiadate.com are not truly seeking a relationship with men from the U.S., but instead are contract employees paid to correspond with Anastasia clients and break their hearts. The emails look to be quite fake, and so anastasiadatefraud.com might be charged with false advertisement. Anastasiadate’s priority is to ensure that all the ladies in the site’s service are authentic girls who are searching for love.”
The complaint says that EM Online are voluntarily false advertising, simply because they know that what they are saying is bogus, and that the email messages were composed with the sole objective of wrongly stopping Anastasiadate’s business. Quite unjustly, Elena’s Models is using ruadventures.com to fend off any competition so that it can prosper at their expense. “While attempting to hide under the cover of an independent, neutral forum site, ruadventures.com actually selectively picks out the positive comments about Elena’s Models and promotes that, while attempting to throw other competition out of the way. Nothing about Anastasiadate is true on this website, as it is quite obvious that the details have been meddled with to shed a poor light on Anastasiadate,” the complaint states.
According to Anastasia, ruadventures.com has also made illegitimate use of the copyrighted logo design to attract customers. “Because of how search engines like google work, while using Anastasiadate’s trademarks has made ruadventures.com much more visible on Google, Yahoo, Bing and other search engines,” according to the complaint. Anastasiadate, needless to say, are pressing for charges. It is represented by Richard C. Yeskoo with Yeskoo Hogan & Tamlyn.
Anastasiadate.com, checked Thursday, offers American guys the “some of the planet’s most desirable girls!” “Few other global online dating internet site comes close,” the site claims. The meta description is “the easiest method to find real women online, using the best consumer protection entirely on a dating site.”
On the anastasiadatefraud.com site, also examined Thursday, an anonymous author claims to tell readers “only the facts” about Anastasia date. He claims Anastasiadate pays third-party firms to employ “young ladies” who are paid out to talk with customers. A female form Ukraine told him these details, and that’s why he’s now exposing it to the world. For chatting and emailing men, these women are promised a high wage and other benefits. The criteria essential for such a “job” are: to be over 18 years of age and to be literate in English and in computers.
This writer claims the girl he corresponded with urged him to subscribe to Elena’s Models, calling it “a serious site.”
